MA License to Carry (Suitable or Unsuitable)

LTC
Effective 1/1/14 there are new standards for denying, suspending or revoking an LTC for unsuitability. The licensing authority may deny the application or renewal of a license to carry, or suspend or revoke a license issued under this section if, in a reasonable exercise of discretion, the licensing authority determines that the applicant or licensee is unsuitable to be issued or to continue to hold a license to carry.
A determination of unsuitability shall be based on:
 Reliable and credible information that the applicant or licensee HAS exhibited or engaged in behavior that suggests that, if issued a license, the applicant or licensee may create a risk to public safety; or
 Existing factors that suggest that, if issued a license, the applicant or licensee MAY create a risk to public safety.
Aggrieved person right to appeal
 Within 90 days of the denial, suspension or revocation
 Within 90 days after the expiration of the time limit for the licensing authority to respond to the applicant
 Any time after a restriction is placed on the license.
Court determination:
 If after a hearing the court finds there is no reasonable grounds for the denial, revocation, suspension or restriction, and the petitioner is not prohibited by law from possessing the license, the justice may order the license to be issued or the restriction to be removed.

 Topics covered in this class will be Massachusetts & Connecticut General Laws pertaining to firearms, safe storage of firearms, safe handling of firearms, child proofing firearms, Identifying and unloading different firearms, cleaning firearms, different types of ammunition and laws pertaining to transportation of firearms. This class is also great for people who want to get into Airsoft guns (To learn safe gun handling). If these guns are handled improperly, there could be some accidental discharge resulting in injuries. If your child wants to get into Airsoft training then he/ she should take this class on gun safety.

At the conclusion of this class you will HAVE THE KNOWLEDGE, SKILLS AND CONFIDENCE NECESSARY FOR OWNING AND USING A FIREARM SAFELY and receive a Massachusetts State Police Certificate and a Certificate of Completion to apply to many other states . This course exceeds the requirements to apply for your Firearms Identification Card (FID) or License to Carry/ Concealed Carry permit in Massachusetts, Connecticut, Rhode Island, New Hampshire, Florida and any other state that requires a LIVE FIRE firearms safety course.

Suddenly the hot topic is 3D printers, the Internet, and Freedom of Speech.

Why?  “Because gun”.

This week, the hot news topic suddenly became 3D printed firearms and the ability to share plans to make one at home.   There’s not much new here regarding this story except for a court victory based on protection of First Amendment rights, which recognizes that the plaintiff, Defense Distributed has the right to share plans on the internet.

Their victory over the State Dept. triggered panic and outrage from the anti Second Amendment coalition, including our Attorney General, Maura Healey, who joined twenty other states in filing suit against the State Department to stop Defense Distributed from sharing plans.

To people that don’t like guns, this probably sounds reasonable.  I’ve even seen some quotes in the news from gun dealers who think this is reasonable.  Let me tell you what they are missing, and why the gun prohibitionists are trying to instill panic in the uninformed public.

First, it’s perfectly legal for a person to make a firearm at home.  This has been happening in the United States since before we were the United States.  If a person is federally prohibited from owning a firearm, it is against the law for them to make one, just like it’s against the law for them to buy one, or file the serial number off of one, or carry one with a filed off serial number.

Second, the plans are already all over the internet.  Yesterday a leading online gun news website published a story with a bunch of links to downloadable files which would give any machinist, the ability to make a receiver, or a gun.

Third, any experienced machinist worth his salt could make most any metal receiver in a day or two, and go into mass production shortly after that without even using plans. Remember when zip guns were all the rage?  Or “Saturday Night Specials”?  This is the 2018 version of that charade.

Fourth, 3D printers capable of making a working firearm cost thousands of dollars.  A criminal isn’t going to take the time to learn how to use a 3D printer, spend said money to acquire the computer and hardware necessary, and start cranking them out when real guns are readily available at a fraction of the cost on the black market.  Not to mention, if a criminal has the skill to operate all of that hardware and software, it’s highly unlikely that they would choose a life of crime.

Last, the anti gun coalition used a lot of scary sounding verbiage about “ghost guns” that can’t be detected by metal detectors.  Those statements are completely and utterly false.  Federal law clearly defines what constitutes an “undetectable gun” and these devices are NOT coming out of 3D printers.  Here are the federal and state laws regarding them.

 

18 USC 922(p) 

(1) It shall be unlawful for any person to manufacture, import, sell, ship, deliver, possess, transfer, or receive any firearm— 

(A) that, after removal of grips, stocks, and magazines, is not as detectable as the Security Exemplar, by walk-through metal detectors calibrated and operated to detect the Security Exemplar; or

(B) any major component of which, when subjected to inspection by the types of x-ray machines commonly used at airports, does not generate an image that accurately depicts the shape of the component. Barium sulfate or other compounds may be used in the fabrication of the component 

Massachusetts Law

Chapter 140, Section 131N. No person shall sell, offer for sale, transfer or possess any weapon, capable of discharging a bullet or shot, that is: (i) constructed in a shape that does not resemble a handgun, short-barreled rifle or short-barreled shotgun including, but not limited to, covert weapons that resemble key-chains, pens, cigarette-lighters or cigarette-packages; or (ii) not detectable as a weapon or potential weapon by x-ray machines commonly used at airports or walk-through metal detectors. Whoever violates the provisions of this section shall be punished, for a first offense, by a fine of not less than $1,000 nor more than $10,000 or by imprisonment for not less than one year nor more than ten years, or by both such fine and imprisonment, and for a second offense, by a fine of not less than $5,000 nor more than $15,000 or by imprisonment for not less than five years nor more than 15 years, or by both such fine and imprisonment.

 

As to the panic generation, the anti gun coalition needs the general public to believe that they are working to keep them safe.  Their oxygen is selling the illusion of safety.  If people were suddenly able to lawfully manufacture their own firearms, for their own personal protection at home, the illusion of safety propagated by gun control legislation would come crumbling down.  And they would come right down with it, finally exposing for all to see, the futility of gun control laws.

This is why they continue to instill fear and propel misinformation, they are scared that the truth will come out, and that’s the last thing they want.

The Bureau of Alcohol, Tobacco and Firearms has reached out to the Massachusetts Firearms Review Board and advised them that they can no longer issue License to Carry or Firearms Identification Cards to Federally Prohibited Persons even if a favorable decision is made by the Firearms License Review Board. 

As of May 11, 2018. The MA Firearms Review Board will NO longer issue FID Cards to federally prohibited persons whose rights to an FID Card have been restored after 5 years under state law. Which means that the persons rights will be revoked.

Excerpt of Letter to Massachusetts Legislature Concerning Restoration of Rights

While Massachusetts has partially restored the rights of certain felons to possess long guns and handguns under certain conditions, this restoration does not remove federal prohibitions. As a result, previously convicted felons who have not had their firearms rights completely restored may not lawfully possess firearms under Federal law and may face prosecution under section 922(g)(1) despite their lawful possession under State law pursuant to valid FID Cards.

NEW MASSACHUSETTS GUN CONTROL PROPOSAL BILL H.3979!!! 10/27/2017

Late last night the senate took up and amended the bill, voted favorably and have sent it to conference committee, where it will be finalized and sent to Governor Baker to be signed.

10/27 Update 2:  ALERT – PLEASE CONTACT YOUR STATE LEGISLATORS AND THE MEMBERS OF THE CONFERENCE COMMITTEE TODAY URGE THEM TO STRIP THE “LINSKY LANGUAGE” FROM THE FINAL VERSION OF THE BUDGET.

Late last night the senate took up and amended the bill, voted favorably and have sent it to conference committee, where it will be finalized and sent to Governor Baker to be signed.

The senate version was amended to include Senator Tarr’s language, which is a drastic improvement over the Linsky language. We will get one or the other of these versions on the final bill, there is no other option at this time.

Take Action!

Please contact the members of the Conference Committee TODAY and urge them to strip the “Linsky language” from the final version of the budget, should it pass it will create a legal quagmire for licensed MA gun owners.

10/27 Update. Please continue calling your legislators about stripping the Linsky language from the house budget, H.3979. (see last post for more info)

This is going to come down to which version gets passed and we need to do everything we can to ensure it’s not the house/Linsky version. Now that the house and senate have each followed procedure and approved the same bill it will go to conference committee. They will approve the final version between the two and send it to Governor Baker to be signed. He is going to sign whatever comes out of committee.

We should know who is going to be on the conference committee later today and we will need to make phone calls once we do.

GOAL has learned that the MA House of Representatives engrossed a new budget bill during informal session today, which includes the Linsky amendment regarding modification of firearms.  The language is in two parts.

The first section (Section 18), copied below, would make any basic modification and or maintenance of a firearm illegal, including required maintenance like lubrication of moving parts.

Section 131R. Whoever possesses, owns or offers for sale any device which attaches to a rifle, shotgun or firearm, except a magazine, that is designed to increase the rate of discharge of the rifle, shotgun or firearm or whoever modifies any rifle, shotgun or firearm with the intent to increase its rate of discharge, shall be punished by imprisonment in the state prison by not less than 3 nor more than 20 years.

The second section (Section 51) is equally egregious in that it gives EOPPS regulatory authority over all maintenance and enhancement of rifles, shotguns, and firearms.  Can you imagine what AG Healey would do should EOPPS be granted this kind of authority?  See language pasted below.

The Secretary of Public Safety shall promulgate regulations by January 1, 2018 concerning the allowability of maintenance and enhancement of rifles, shotguns and firearms consistent with the intent of this section.

We are being told that Governor Baker will sign this into law, by Tuesday, October 31, 2017.  Please take action immediately

Take Action

Please call your state representative and senator immediately!  Let them know that this amendment must be stripped from the budget bill.  This language is so broad and open to interpretation and abuse that it will cause a legal quagmire for licensed gun owners in Massachusetts.

Summary of H.J.Res.40.

 This joint resolution nullifies the “Implementation of the NICS Improvement Amendments Act of 2007 rule finalized by the Social Security Administration on December 19, 2016. The rule implements a plan to provide to the National Instant Criminal History Background Check System the name of an individual who meets certain criteria, including that benefit payments are made through a representative payee because the individual is determined to be mentally incapable of managing them. (Current law prohibits firearm sale or transfer to and purchase or possession by a person who has been adjudicated as a mental defective.) (This includes Military Veterans with PTSD or other mental issues such as brain damage from combat).

View Related ArticlesFairfax, Va.— The National Rifle Association Institute for Legislative Action (NRA-ILA) applauded President Donald Trump today for signing H.J. Res. 40, revoking a last-minute gun grab issued at the end of the Obama administration.

“Today marks a new era for law-abiding gun owners, as we now have a president who respects and supports our right to keep and bear arms,” said Chris W. Cox, executive director, NRA-ILA. “Our thanks go to President Trump and the congressman and senators who led the fight for this important legislation.”

H.J. Res. 40 passed both the House and the Senate with bipartisan support. The bill revokes an Obama-era rule that would have stripped Second Amendment rights from tens of thousands of people each year without due process.

Details of the action:

  • Under the Congressional Review Act, Congress is allowed to review, and revoke, any action an outgoing administration made in its final 60 legislative days. This rule falls under that time frame.
  • The rule, finalized in December, would have resulted in 75,000 social security recipients who use a representative payee losing their Second Amendment rights without due process.
  • The now-revoked rule would have affected those on disability for conditions that include eating disorders and anxiety.

The move to revoke the rule was supported by the NRA, the ACLU, and more than a dozen mental health advocacy organizations.

“We are pleased that this example of government overreach will no longer be pursued,” concluded Cox.
